Can you get Social Security
Disability for back and neck pain? Absolutely, in fact, the
largest percentage of all Social Security Disability claims
throughout the country involves back and neck pain. I would
say in my practice 50% of the claimants that I represent have
disabilities based upon injuries to their neck and their back.
Well, why is this important to know? Well, there are certain
ways to prove a back and neck case, okay? If you’re a younger
individual, what do we have to prove? Well, we have to prove
not only that you can’t do what you used to be able to do, but
that you also can’t do what they call sedentary work. What is
sedentary work? Sedentary work is just a fancy name for sit
down work, a person who sits primarily for six out of eight
hours a day. Now, if you’re a sufferer with back and neck pain
and you have a severe spinal problem, you know that sometimes
sitting is one of the worst things that causes you pain. So
many times the way we prove our cases is we are able to get the
claimants treating physician to write a report saying that the
claimant cannot sit or stand for longer than two to three hours
at a time. If you can’t sit for two to three hours at a time,
then there’s no way you can sit for six out of eight hours a
day. And if that’s the case and you’re treating physician says
that, then you’re on the road to winning a Social Security claim.
